By signing up for an account, you’re agreeing to these Terms, which will result in a legal agreement between you and KITECH (“Agreement”).
We’ll start with the basics, including a few definitions that should help you understand these Terms.
KITECH (“KITECH LTD,” “we,” or “us”) is a brand creation platform (the “App”) that allows you to register your brand domain name, create branded emails and , create and host your brand website, to reach your people and sell your things (each, a “Site,” and collectively, “Sites”) among other things.

KITECH is a Software engineering company established with the aim of providing digital solutions and Software Engineering Services to different initiatives in Rwanda and World wide.
KITECH has employees, independent contractors, and representatives (“our Team”). As a customer of the Service or a representative of an entity that’s a customer of the Service, you’re a “Member” according to this Agreement (or “you”). Member’s account may have access to unique features of the Service based on their historic usage or status. If you have any questions about our Terms, feel free to contact us at info@kitech.rw
By using the Service, you represent and warrant that you meet all the requirements listed above, and that you won’t use the Service in a way that violates any laws or regulations. Note that by representing and warranting, you are making a legally enforceable promise.
Kitech may refuse service, close accounts of any Members, and change eligibility requirements at any time.
When you sign up for an account and agree to these Terms, the Agreement between you and Kitech is formed, and the term of the Agreement (the “Term”) will begin. The Term will continue for as long as you have a Kitech account or until you or we terminate the Agreement in accordance with these Terms, whichever happens first. If you sign up for an account on behalf of a company or other entity, you represent and warrant that you have the authority to accept these Terms and enter into the Agreement on its behalf.
You or Kitech may terminate the Agreement at any time and for any reason by terminating your Kitech account or giving notice to the other party. We may suspend the Service to you at any time, with or without cause. Once your account is terminated, you acknowledge and agree that we may permanently delete your account and all the data associated with it, including your Campaigns.
We may change any of the Terms by posting revised Terms on our KITECH Site. Unless you terminate your account, the new Terms will be effective immediately upon posting and apply to any continued or new use of the Service. We may change the Service, Add-ons, or any features of the Service at any time, and we may discontinue the Service, Add-ons, or any features of the Service at any time.
You’re responsible for keeping your account name, usernames and password confidential. You’re also responsible for any account that you have access to and any activity occurring in such an account (other than activity that Kitech is directly responsible for that isn’t performed in accordance with your instructions), whether or not you authorized that activity. You’ll immediately notify us of any unauthorized access or use of your accounts. We’re not responsible for any losses due to stolen or hacked passwords. We don’t have access to your current password, and for security reasons, we may only provide you with instructions on how to reset your password. We have the right to update any of your contact information in your account for billing purposes. In addition, you represent and warrant that all information you provide to us when you establish an account, and when you access and use the Service, is and will remain complete and accurate. We may contact you, or any seat, authorized user, or login added to your account, based on the information provided in your account.
We don’t know the inner workings of your organization or the nature of your personal relationships. You won’t request access to or information about an account that’s not yours, and you’ll resolve any account-related disputes directly with the other party. We decide who owns an account based on a number of factors, including the content in that account, and the contact and profile information listed for that account. In cases where differing contact and profile information is present or we are unable to reasonably determine ownership, we’ll require you to resolve the matter through proper channels outside of Kitech. When a dispute is identified, we may suspend any account associated with the dispute, including disabling login and sending capabilities, to protect the security and privacy of the data held within the account until the dispute is properly resolved.
Kitech shall render memory and computing capacity available, on a server operated by Kitech, for the storage of websites and for the operation of applications that can be utilised via the internet.
Suite and Signature place your data on one server and resources are shared among multiple clients on that same server. However, we work to ensure that you space and bandwidth is always available.
We shall create, grant and maintain the connection between the server and the internet so that the data stored on the server can be transmitted to the calling computer without disruption and whenever required by external computers in the internet (clients) by means of the common internet protocols.
We shall endeavour to render the data, stored by the contract partner in accordance with the Terms and Conditions of the agreement, available to the global public via the internet 24 hours a day, seven days a week. We does not accept liability for successful access to the respective website, insofar as networks are used that are not exclusively operated by Kitech or its direct contractors including their interfaces to third-party networks.
We shall schedule maintenance times for the optimisation and improvement of performance of the systems providing the services, which are, on principle, outside the usual business hours, generally on Sunday between 2 am and 3 am and are only utilised as required. During these maintenance times Kitech may shut down its technical facilities as necessary and to a scope that is restricted to a minimum. The customer shall be informed of the execution of maintenance outside the above-mentioned maintenance times by e-mail in a timely manner.
We shall endeavour to render the systems available via internet for at least 98.5% of the annual operating time (availability).
We shall execute an automatic back-up of the stored data on a motnhly basis. The back-up copies shall in general be stored for a period of 30 days.
The customer is responsible for maintaining its data on the server. The customer is given a password and the internet address to alter and update the data.
The customer is obliged not to disclose the login information to unauthorised third parties. Customers shall inform Kitech immediately if they obtain knowledge that unauthorised third parties are aware of the password. Unauthorised third parties are not such persons who utilise storage, which forms the subject matter of the agreement, with the knowledge and agreement of the customer.
Customers shall provide assurance that they do not enter any contents, which infringe legal regulations, third party personal rights and trademark rights or morality. Customers must in particular heed the data protection provisions to the benefit of the users.
In the event of an infringement of the above condition, customers are obliged to refrain from all further infringements, to compensate Kitech for the resultant or resulting loss and to indemnify and exempt Kitech from third party claims for damages and the reimbursement of expenses caused by the infringement. The exemption obligation also extends to the obligation to fully exempt Kitech from all legal defence costs (costs for courts, lawyers, etc.).
This does not affect Kitech’s right to take further measures, in particular to bar the contents and to issue an extraordinary notice of termination.
Kitech will register domain names on behalf of the customer with the respective issuing body.
The customer authorises Kitech to issue all declarations or execute all activities necessary for registration of a domain with the respective issuing body, on behalf of the customer.
The customer can only expect the actual assignment of the domain name once this has been confirmed by Kitech.
Kitech shall not accept liability and provides no guarantee in respect of the assignment of the domain name orders.
the customer shall indemnify Kitech against any third party claims in respect of the domain name selected.
You agree that transfer of your domain name(s) services shall be governed by ICANN's transfer policy, available Here, as this policy may be modified from time to time.
You agree that we may place a "Registrar Lock" on your domain name services and that this will prevent your domain name services from being transferred without your authorization, though we are not required to do so. By allowing your domain name services to remain locked, you provide express objection to any and all transfer requests until the lock is removed. To transfer your domain name(s) you should first login to your account to lock or unlock your domain name(s) and/or to obtain the EPP "AuthCode" which is required to transfer domain services in an EPP registry (such as .org , .com).
Only the registrant and the administrative contacts listed in the WHOIS information may approve or deny a transfer request. Without limitation, domain name services may not be transferred within 60 calendar days of initial registration, within 60 calendar days of a transfer, if there is a dispute regarding the identity of the domain name registrant, if you are bankrupt, or if you fail to pay fees when due. Transfer requests typically take 2 business days to be processed. A transfer will not be processed if, during this time, he domain name registration services expire in which event you may need to reinstate the transfer request. You may be required to resubmit a transfer request if there is a communication failure.
As a consequence, you acknowledge that you assume all risk for failure of a transfer if the transfer process is initiated close to the end of a registration term.
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted to You or by You through the Services, are the sole responsibility of the person from whom such Content originated. This means that You are entirely responsible for all Content You upload, email, transmit or otherwise make available via the Services.
We shall exercise no control over the content transmitted via the Services and, as such, does not guarantee or accept responsibility for its accuracy, integrity or quality. You understand that by using the Services, You may be exposed to content that is offensive, indecent or objectionable. Under no circumstances will We be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content uploaded, emailed, transmitted or otherwise made available via the Services. We has no obligation to monitor the content transmitted via the Services.
All our products are offered in packages and are packed into one yearly subscription plan. Payment invoices are issued once in a year 30 days before the expiration date which is the due date, Once renewed the expiring date will be set to the same day next year.
We’ll give you a refund for a prorated portion of any prepaid amounts for the Service if we stop providing the Service and terminate your account without cause. You won’t be entitled to a refund or credit from us under any other circumstances. We may, at our sole discretion, offer a refund, discount or credit.
We may change any of our fees, including our charges for Yearly Plans, at any time by posting a new pricing structure to our Kitech Site or in your account and/or sending you a notification by email. Quoted fees don’t include sales or other transaction-based taxes of any kind.
You shall retain all right, title, and interest in and to the material, content, data, and information (including your personal information and the personal information of others) you submit to Kitech in the course of using the Service or which Kitech otherwise retrieves or accesses at your direction or with your permission (collectively, your “Content”).
We own all proprietary rights in the Service and Kitech Site, including, but not limited to, patents, trademarks, service marks, trade secrets, copyrights, and other intellectual property rights. You will respect our proprietary rights in the Service and Kitech Site, and you may only use our brand assets upon request and our approval.
In an effort to protect our clients' and site visitors privacy and rights, Kitech has established a Privacy Policy which explains what information we gather on visitors and what we do with information that we gather.
This Privacy Policy governs the manner in which Kitech collects, uses, maintains and discloses information collected from users of this Web site (each, a "User").
Users' privacy is very important to Kitech. We are committed to safeguarding the information Users entrust to Kitech.
Kitech collects personally identifiable information from Users through online forms for ordering products and services. We may also collect information about how Users use our Web site, for example, by tracking the number of unique views received by the pages of the Web site or the domains from which Users originate. We use "cookies" to track how Users use our Web site.
Kitech may use personally identifiable information collected through our Web site to contact Users regarding products and services offered by Kitech and its trusted affiliates, independent contractors and business partners, and otherwise to enhance Users' experience with Kitech and such affiliates, independent contractors and business partners. At no time will Kitech's database of users ever be sold to any entity for the purpose of marketing or mailing lists. Personal information will not be sold or otherwise transferred to our business partners without your prior consent, except that we will disclose the information we collect to third parties when, in our good faith judgment, we are obligated to do so under applicable laws.
Kitech doesn’t allow accounts that promote or incite harm toward others or that promote discriminatory, hateful, or harassing Content.
Kitech also does not allow the distribution of Content that is, in our sole discretion, materially false, inaccurate, or misleading in a way that could deceive or confuse others about important events, topics, or circumstances. If you violate any of these rules, then we may issue a warning to, suspend, or terminate your account.
Where there’s a conflict between these Terms, the Additional Terms will control the extent of the conflict. Congratulations! You’ve reached the end.
